1. Agreement to Terms

These Terms & Conditions (“Terms”) govern your access to and use of the Art Hustle Insider membership community, website(s), portals, and related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Definitions

  • “Company,” “we,” “us,” or “our” means Art Hustle Insider (operated by Art Hustle, LLC.).

  • “Member,” “you,” or “your” means any individual or entity accessing or using the Service.

  • “Content” means all materials made available through the Service, including trend reports, posts, text, images, templates, reference materials, and catalogs.

  • “Member Content” means content you upload or submit (e.g., artwork, text, images, comments).

  • “Buyer” means vetted industry professionals granted access to Buyer-facing areas of the Service.

  • “AI-Generated Artwork” means content created in whole or in part using artificial intelligence tools, including but not limited to image generators, model inpainting/outpainting, and similar systems.

3. Membership & Access

3.1 Eligibility. You must be at least 18 years old and able to form a binding contract.
3.2 Account. You must provide accurate information and maintain the security of your login credentials. You are responsible for all activity under your account.
3.3 Private Community. The Service is a subscription-based community. Access is limited to current Members. Sharing, sublicensing, reselling, or redistributing access or Content outside the Service is prohibited.

4. Intellectual Property & License

4.1 Our Content. Except for Member Content and third-party materials, the Service and all Content are owned by the Company and/or its licensors and are protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use during your active membership.
4.2 Reference Materials. Any reference images or materials we share in trend reports, posts, or the Service are for inspiration and education only and remain the copyright of their original owners. You may not copy, trace, reproduce, or adapt such materials for the purpose of reselling or commercializing them as products.
4.3 Member Content Ownership. You retain all rights in your Member Content. By submitting Member Content, you represent and warrant that you own or have all necessary rights to do so.
4.4 License to Company. You grant the Company a worldwide, royalty-free, non-exclusive license to host, store, reproduce, display, distribute, and otherwise use your Member Content solely to (i) operate the Service; (ii) provide peer and instructor feedback; and (iii) present accepted artwork to vetted Buyers (including posting to Buyer channels and monthly Trend Wrap Up catalogs).
4.5 Buyer Listings & Anonymity. Buyers may be displayed in the Service as categories or roles (e.g., BUYER (MFR) Dinnerware). The Company may maintain Buyer anonymity unless a Buyer chooses to disclose contact details.
4.6 AI-Generated Artwork.
a) Disclosure. If you use AI tools for any portion of your artwork (in part or in whole), if asked you must clearly disclose that fact at submission. The Company may display such disclosure to Buyers and/or use it internally for review.
b) Responsibility & Rights Clearance. You are solely responsible for ensuring that your submissions—including AI-assisted or AI-generated elements—do not infringe copyrights, trademarks, rights of publicity, moral rights, or other third-party rights. You represent and warrant that you have all necessary rights and licenses for any training data, prompts, inputs, or outputs used to create your submission, where applicable.
c) Prohibited Uses. Submissions that directly copy, closely mimic, or otherwise infringe existing copyrighted works or protected characters/IP (including outputs that replicate another identifiable artist’s style where such use would violate applicable law or platform terms) are prohibited. The Company may reject or remove AI-generated submissions that pose legal, ethical, or reputational risk.
d) Ownership Assertions. The Company makes no warranty or representation as to the copyrightability or ownership status of AI-generated works. You acknowledge that laws governing AI authorship and protectability are evolving and may vary by jurisdiction.
e) Buyer Notice. Buyers should evaluate legal risk and obtain their own advice before licensing AI-assisted or AI-generated works. The Company disclaims liability for disputes arising from the licensing or use of such works.

5. Acceptable Use & Member Conduct

You agree not to:
a) upload or share content that infringes any third-party rights;
b) harass, threaten, defame, or otherwise harm others;
c) collect information (including personal data) without consent;
d) circumvent access controls or security;
e) reproduce, distribute, or publicly display Content outside the Service without authorization;
f) upload malware or interfere with the Service’s functioning.
We may monitor, reject, or remove any content or account that, in our discretion, violates these Terms.

6. Payments, Renewals, and Refunds

6.1 Monthly Subscriptions. You may cancel any time before 12:00 AM (CST) on the 1st of the next month to avoid charges for that month. Once the 1st occurs, you will be billed for the entire month and no refund will be issued.
6.2 Annual Plans. Annual subscriptions are non-refundable.
6.3 Digital Downloads. All PDF/digital product sales are final and non-refundable.
6.4 Fees & Changes. We may change fees prospectively. We will notify you of material changes in advance where required by law.

7. Posting Windows & Catalogs

Submissions to trends close at 11:59 PM CST on the last day of each month. Accepted artwork may be included in the Trend Wrap Up catalog and posted in Buyer channels. Trend Wrap Ups remain accessible to Buyers, including for prior months.

8. Privacy

Your use of the Service is subject to our Privacy Policy (below), which explains how we collect, use, and share personal data.

9. Disclaimers

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO THE COMPANY FOR THE SERVICE IN THE 3 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to defend, indemnify, and hold harmless the Company and its officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your Member Content (including AI-generated submissions), or your violation of these Terms or applicable law.

12. Suspension & Termination

We may suspend or terminate your access if you breach these Terms, misuse the Service, or engage in conduct that, in our judgment, may harm others or the integrity of the Service. Upon termination, all licenses granted to you terminate immediately.

13. Changes to the Service and Terms

We may modify or discontinue portions of the Service at any time. We may update these Terms from time to time. Changes take effect upon posting unless otherwise specified. Continued use after changes constitutes acceptance.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Illinois, USA, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in  Cook County, Illinois.

Privacy Policy

This Privacy Policy describes how we collect, use, disclose, and protect personal information in connection with the Service.

1. Information We Collect

  • Account & Profile Data: name, email, password (hashed), optional website/Instagram, role (e.g., Artist or Buyer).

  • Payment Data: processed by our payment processor; we do not store full payment card details.

  • Member Content: artwork (including any disclosed AI use), comments, messages, posts.

  • Usage Data: IP address, device/browser info, pages viewed, timestamps, referral URLs, approximate location.

  • Buyer Vetting Data: limited professional details used to verify Buyer status.

  • Communications: emails and messages you send to us.

2. How We Use Information

We use personal information to:
a) provide, operate, and improve the Service;
b) manage accounts, authenticate users, and process payments;
c) display Member Content in community areas, Buyer channels, and Trend Wrap Ups
d) facilitate connections between Buyers and Artists and enable direct contact when an Artist’s work is accepted (e.g., including email/links on catalog pages);
e) send administrative and trend-related communications;
f) enforce our Terms and protect the Service.

3. Disclosure of Information

We may disclose information to:

  • Service Providers (e.g., hosting, analytics, payment processing) under confidentiality obligations;

  • Buyers (limited Artist contact details and accepted artwork) to facilitate outreach;

  • Legal/Compliance when required by law, court order, or to protect rights, safety, and security;

4. Buyer Privacy & Anonymity

By default, Buyers may appear in the community with limited profile information (e.g., category/role) and may choose whether to share direct contact details. We respect Buyer anonymity unless a Buyer elects to make their information public.

5. Data Retention

We retain information as long as necessary to provide the Service, comply with legal obligations, resolve disputes, and enforce agreements. Trend Wrap Ups and Buyer-facing catalogs may remain available to Buyers after the relevant month(s).

6. Security

We use commercially reasonable safeguards to protect personal information. No method of transmission or storage is 100% secure.

7. Children’s Privacy

The Service is not directed to children under 18. We do not knowingly collect personal information from children under 18. If we learn we have collected such data, we will delete it.

8. Your Choices & Rights

  • Access/Update. You may access or update your profile information through your account.

  • Deletion. You may request deletion of your personal information, subject to legal/operational retention needs.

  • Marketing Emails. You may opt out of non-essential emails via unsubscribe links.

9. International Transfers

We may process information in the United States and other jurisdictions. By using the Service, you consent to such transfers.

10. Cookies & Tracking Technologies

We and our service providers use cookies, pixels, beacons, and similar technologies to operate and improve the Service.

  • Necessary Cookies: required for login, security, and core functionality.

  • Preference Cookies: remember settings and choices.

  • Analytics Cookies: help us understand usage to improve the Service.
    You can control cookies via your browser settings; disabling some cookies may limit functionality.

11. Third-Party Social Media Services

If you choose to register or log in via third-party services (e.g., Google, Facebook, Instagram, LinkedIn), we may receive certain profile information authorized by you (such as name and email). Your use of those services is governed by their respective terms and privacy policies. You may disconnect third-party logins in your account settings (where supported).

12. Third-Party Links

The Service may contain links to third-party websites or services. We are not responsible for their content or privacy practices.

13. Changes to this Privacy Policy

We may update this Privacy Policy from time to time. We will post the updated policy with a revised “Last updated” date. Your continued use constitutes acceptance of the changes.
